Any extraction or reuse of a substantial part of a Website database, as well as any repeated or systematic extraction of non-substantial parts, is prohibited without prior authorisation.
Automated use of the Website for bulk collection, scraping, unauthorised indexing, database creation, training of automated systems or republication is prohibited unless prior written permission has been granted or applicable law provides otherwise.
Article 8. Trademarks, Names and Distinctive Signs
The names MAXImini and MAXImini.com, together with the logos, trademarks and distinctive signs displayed on the Website, remain the property of their respective owners.
Nothing in these Terms shall be interpreted as granting users any licence or right to use these elements.
Article 9. Hyperlinks
The Website may contain links to websites or services operated by third parties. These links are provided for information purposes only. The publisher does not continuously monitor these external resources and cannot be held liable for their availability, content, security, commercial practices or handling of personal data.
Users may create a simple link to a page on the Website provided that this does not create confusion regarding the origin of the content, present MAXImini.com as a partner without permission or harm the publisher’s interests, image or reputation.
Framing, embedding or otherwise displaying a Website page within another website is prohibited without prior written permission.
Article 10. Contributions, Comments and User-Submitted Content
Where the Website allows users to submit a message, comment, document, photograph, video or other content, users warrant that they hold all necessary rights and permissions.
Users must not publish or submit content that:

infringes privacy, image rights, the presumption of innocence, confidentiality of correspondence or any other third-party right;
reproduces a protected work, trademark, photograph or other protected element without permission;

The publisher may moderate, reject, hide or remove any content that is manifestly unlawful or contrary to these Terms. Access to interactive features may also be restricted in the event of misuse.
Users remain solely responsible for content they submit. Where a contribution is intended for publication, the user grants the publisher a non-exclusive, royalty-free licence to reproduce, display, adapt it to the relevant editorial format and distribute it on the Website and associated communication channels, worldwide and for the legal term of protection, subject to the author’s moral rights.
Article 11. Reporting Illegal Content
Users may report content they consider illegal or harmful to their rights through the form available at https://www.maximini.com/contact.
Reports must be sufficiently precise and should, where possible, include the requester’s identity and contact details, the exact location of the content, the legal grounds for the report and any relevant supporting evidence.
The person making a deliberately false or abusive report may incur legal liability.
Article 12. Advertising and Sponsored Content
The Website may display advertisements, commercial communications, sponsored links, advertorials, partner content or special promotional features. Such content must be identifiable as advertising or sponsored content through appropriate wording or presentation.
Advertisers remain responsible for their offers, products, services, statements and commitments. The display of an advertisement does not constitute a recommendation or guarantee by the publisher.
Any contractual relationship entered into between a user and an advertiser or partner is independent of the publisher, unless expressly stated otherwise.
Article 13. Personal Data
In operating the Website, the publisher may process personal data, in particular when a user submits a contact form, correction request, report, newsletter subscription, promotion entry or uses certain Website features.
The processing of personal data, its purposes, legal bases, retention periods, recipients, any transfers outside the European Economic Area and the methods available to exercise data protection rights must be set out in a separate Privacy Policy accessible from the Website.
Subject to applicable data protection law, data subjects may exercise rights of access, rectification, erasure, restriction, objection and portability, and may withdraw consent where processing is based on consent.
Requests concerning personal data may be submitted through the form available at https://www.maximini.com/contact.
Data subjects also have the right to lodge a complaint with the French Data Protection Authority, the Commission nationale de l’informatique et des libertés, or CNIL.
Article 14. Cookies and Other Trackers
The Website may use cookies and other trackers required for its operation, security, audience measurement, content personalisation, video display, integration of third-party services or advertising.
Trackers that are not strictly necessary must only be stored or accessed after obtaining the user’s consent where such consent is required. Users must be able to accept or refuse these trackers with the same level of ease and to withdraw their consent at any time.
Detailed information concerning the trackers used, their purposes, duration and available settings must be provided in a Cookie Policy accessible from the Website.
Article 15. Security and Prohibited Uses
Users undertake to use the Website fairly and for its intended purpose. In particular, users must not:
attempt to gain unauthorised access to the Website’s systems, servers, accounts, data or protected areas;
alter, disrupt, slow down or interrupt the operation of the Website;
introduce malicious code, bypass a security measure or test a vulnerability without written permission;
impersonate another person or fraudulently collect data;
use the Website for illegal or fraudulent purposes or in a manner that infringes the rights of the publisher or any third party.
Any breach may result in restricted or suspended access, without prejudice to any civil or criminal proceedings that may be brought.
Article 16. Liability
The publisher shall not be liable for indirect loss or damage arising from use of the Website, temporary inability to access it, technical incompatibility, a cyberattack, an external event or use of a third-party website.
The publisher shall not be liable for decisions made by a user solely on the basis of general content published on the Website.
The limitations set out in this Article do not apply where liability cannot be excluded or limited under mandatory law, including in cases of gross negligence, wilful misconduct, personal injury or breach of an essential legal obligation.
Article 17. Changes to the Website and These Terms
The publisher may amend the Website’s content, organisation, features and these Terms to reflect changes to the Website, its services, applicable law or editorial practices.
The applicable version is the one published on the Website at the time of consultation. The date of the latest update appears at the beginning of this document.
Article 18. Severability
If any provision of these Terms is declared invalid, unlawful or unenforceable, the remaining provisions shall continue in full force and effect. To the extent permitted by law, the affected provision shall be replaced by a valid provision having an effect as close as possible to the original intention.
Article 19. Governing Law and Dispute Resolution
These Terms are governed by French law.
In the event of a dispute, users are encouraged to contact the publisher first in order to seek an amicable solution.
If no amicable agreement can be reached, the dispute shall be submitted to the courts having jurisdiction under applicable law. Nothing in these Terms deprives a consumer of any mandatory rules concerning jurisdiction or consumer protection from which they benefit.
